1. Principles and Scope

Swiss Bar Shop respects the privacy of all users of the website and online shop (hereinafter “customer” or “customers”).

This privacy policy explains which personal data is collected, how it is processed and what rights customers have. Swiss Bar Shop complies with the Swiss Federal Act on Data Protection (revFADP) and, where applicable, the requirements of the EU General Data Protection Regulation (GDPR).

Swiss Bar Shop processes personal data exclusively for the purposes for which it was provided or collected.

This privacy policy may be amended from time to time. The current version published on the website always applies.

2. Type and Purpose of the Data Collected

Personal data is information relating to an identified or identifiable natural person (e.g. name, address, email address).

Processing personal data covers any handling of such data, such as collecting, storing, using, disclosing, transferring or deleting it.

Swiss Bar Shop collects data:

  • automatically when the website is visited (e.g. log files, cookies),
  • through direct input by the customer (e.g. order, registration, contact form).

2.1 Automatically Collected Data

When the website is accessed, server log files are stored automatically (e.g. IP address, date/time, browser, operating system, provider). They serve to ensure technical operation and IT security and to optimize the offering.

Cookies may be used in this context (see section 4).

2.2 Data for Orders, Customer Accounts and Contact Requests

When an order is placed, an account is registered or contact is made, Swiss Bar Shop collects the personal data required for this purpose (e.g. name, address, email, payment data).

This data is used exclusively for processing the contract and communicating with the customer. Mandatory fields are marked accordingly; without this information, an order or registration is not possible.

After the contract has been fully processed or the customer account has been deleted, the data will continue to be processed only to a limited extent and will be deleted once the statutory retention periods have expired, unless consent to further use has been given.

The customer account can be deleted at any time by sending a message to the contact details below or directly via the account function.

3. Legal Basis for Processing

Depending on the purpose, the processing of personal data is based on:

  • performance of a contract (e.g. processing an order),
  • legal obligations (e.g. accounting),
  • legitimate interests of Swiss Bar Shop (e.g. IT security, direct marketing),
  • the customer’s consent (e.g. newsletter).

Consent given can be withdrawn at any time. The lawfulness of the processing carried out until then remains unaffected.

4. Cookies, Analytics Services and External Content

4.1 Cookies

Swiss Bar Shop uses cookies to improve user-friendliness (e.g. shopping cart, language selection).

  • Session cookies: are deleted automatically when the browser is closed.
  • Persistent cookies: remain stored for longer and enable recognition.

Customers can disable cookies in their browser. However, this may restrict functionality.

4.2 Web Analytics & Marketing

For statistics, optimization and marketing, Swiss Bar Shop uses the following services, among others:

  • Google Analytics (Google Ireland Limited, Dublin, Ireland)
    • is used to analyze user behavior.
    • IP addresses are processed in anonymized form.
    • Transfers to the USA are based on Standard Contractual Clauses (SCC).

4.3 Social Media Plugins

Swiss Bar Shop may use plugins from Facebook, Instagram, Twitter, etc.

When a page with a plugin is accessed, a connection to the servers of these providers is established, even if there is no account with them or no one is logged in.

The purpose and scope of the data collection are set out in the privacy policies of the respective providers:

Customers can block plugins by using browser add-ons (e.g. a “Facebook blocker”).

5. Newsletter

Swiss Bar Shop offers a newsletter using the double opt-in procedure.

Data used:

  • email address
  • optional details (for personalization)
  • information on opening and click behavior (to optimize the content)

The newsletter can be unsubscribed at any time via the unsubscribe link or by notifying Swiss Bar Shop. The data is used exclusively for sending the newsletter and is not passed on to third parties for their own purposes.

6. Disclosure of Data

Swiss Bar Shop only discloses personal data if:

  • the customer has expressly consented,
  • this is necessary to process the contract (e.g. payment service providers, shipping service providers),
  • there is a legal obligation to do so.

Commissioned third-party service providers (e.g. hosting, newsletter, payment processing, logistics) are contractually obliged to process the data only in accordance with instructions and with appropriate safeguards.

7. Data Security

Swiss Bar Shop takes technical and organizational measures (TOMs) to protect personal data against loss, misuse, unauthorized access, disclosure or destruction.

Nevertheless, data transmission over the internet (e.g. by email) may have security gaps. Absolute protection against access by third parties is not possible.

8. Customer Rights

Within the scope of applicable data protection law, customers have in particular the following rights:

  • access to the personal data processed
  • rectification of inaccurate or incomplete data
  • erasure (“right to be forgotten”), unless statutory retention obligations apply
  • restriction of processing
  • data portability (where technically feasible)
  • objection to certain processing (e.g. direct marketing)
  • withdrawal of consent given, with effect for the future

To exercise these rights, a message to the contact details given in section 9 is sufficient.

10. Final Provisions

Should individual provisions of this privacy policy be invalid, the validity of the remaining provisions shall remain unaffected.
