Terms of service

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by customers (hereinafter referred to as “Customer”) residing in Switzerland and in the Principality of Liechtenstein via the website www.barshop.ch.

Customers within the meaning of these GTC are exclusively consumers, i.e. natural persons who are not acting for commercial or self-employed professional purposes. Orders in quantities that are not customary for households may be rejected.

Swiss Bar Shop reserves the right to amend these GTC at any time. The version valid at the time of the order is decisive.

2. Information on the website

All information about products and services (product descriptions, illustrations, dimensions, weights, technical specifications, etc.) is for illustrative purposes only and is non-binding, unless expressly stated otherwise.

We reserve the right to make changes to prices and product ranges as well as technical adjustments. Information about availability and delivery times is non-binding.

3. Prices

All prices are quoted in Swiss francs (CHF) and include VAT and statutory charges (e.g., advance recycling fees).  

Shipping costs are shown separately during the ordering process and may be charged additionally.  

Swiss Bar Shop reserves the right to change prices at any time. Errors and misprints are excepted.

4. Conclusion of contract

The product descriptions on the website are non-binding.

By submitting the order and accepting these terms and conditions, the customer makes a binding offer to conclude a contract. Swiss Bar Shop confirms receipt of the order by email. This confirmation does not constitute acceptance of the offer.

A contract is only concluded when Swiss Bar Shop confirms the shipment of the goods or the provision of the service by email.

Orders will only be executed after full payment has been received (unless payment on account has been agreed) and if the goods are available.

The contract for personalized products is concluded when the customer uploads the design. Once the design has been uploaded and the order process completed, the product will be manufactured according to the customer's specifications. It is not possible to cancel or change the order after the design has been uploaded.

5. Payment options & retention of title

The available payment methods are displayed during the ordering process.

Swiss Bar Shop may exclude customers from certain payment methods or require advance payment without giving reasons.

The delivered goods remain the property of Swiss Bar Shop until full payment has been received.

6. Delivery, obligation to inspect & returns

Delivery is made to the address specified by the customer by post or courier. Specified delivery times are non-binding. Partial deliveries are possible without additional shipping costs.

The customer is obliged to inspect the goods immediately upon receipt and to report any defects in writing (by email or letter to the address specified in the legal notice) without delay.

Returns are at the risk and expense of the customer, unless there is a defect for which Swiss Bar Shop is responsible.

Image review and liability: All uploaded designs are technically reviewed, but we accept no liability if the design does not meet expectations due to inappropriate or faulty image material. Returns due to inappropriate designs are excluded. The customer is responsible for the quality and legal admissibility of the uploaded design.

7. Contractual right of return (right of withdrawal)

Although Swiss law does not provide for a statutory right of withdrawal, Swiss Bar Shop voluntarily grants its customers a 14-day right of return.

The period begins upon receipt of the goods. To meet the deadline, it is sufficient to notify us of the withdrawal in writing (by email or letter). The goods must be returned within 10 days.

Requirements:

  •     Original packaging and complete accessories
  •     Unused, undamaged condition

Exceptions to the right of return:

  •     Perishable goods, hygiene items, or unsealed food
  •     Goods made to customer specifications or custom-made items
  •     Already opened, discounted, or clearance items

Payments already made will be refunded within 20 days of receipt of the goods or proof of return. Swiss Bar Shop reserves the right to make deductions for depreciation due to improper use.

Personalized products: Products that are customized according to customer specifications (e.g., engravings or logos) are excluded from the right of return, unless the product has a defect that is attributable to faulty manufacturing. Returns due to design errors on the part of the customer are not possible. The customer confirms that the uploaded design does not infringe on any third-party copyrights or trademark rights.

8. Warranty

Swiss Bar Shop only delivers goods that are in perfect condition. For consumer goods, the statutory warranty period of two years from the date of delivery applies.

In the event of defects, Swiss Bar Shop will decide at its discretion on:

  •     Repair,
  •     Replacement delivery, or
  •     Refund of the purchase price.

Damage caused by improper use, normal wear and tear, or external influences, as well as consumable parts (e.g., batteries), are excluded from the warranty.

Further warranty rights are excluded to the extent permitted by law.

9. Liability

Swiss Bar Shop is liable without limitation for intent and gross negligence.
Swiss Bar Shop is only liable for slight negligence in the event of a breach of essential contractual obligations.

Any liability for indirect damage, consequential damage, or loss of profit is excluded to the extent permitted by law.

Liability for personal injury remains unaffected.

Liability for design: The customer is responsible for the suitability of the design. We accept no liability for designs that cannot be engraved as desired due to ambiguities or faulty image files. The customer confirms that the design does not infringe any third-party rights and is suitable for engraving.

10. Data protection

The personal data collected in connection with the order will be used exclusively for contract processing and for our own marketing purposes.

Data will only be passed on to necessary service partners (e.g., logistics companies).

Data protection for uploaded designs: The uploaded designs are used exclusively for personalizing the product. We guarantee that your design data will not be used for any other purpose or passed on to third parties. The customer confirms that the design does not infringe any third-party copyrights.

11. Severability clause

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

12. Applicable law & place of jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction is Zurich or the customer's place of residence.

14. Additional B2B provisions (for commercial customers)

The following supplementary provisions apply to commercial customers, i.e. companies, tradespeople, or other legal entities: Goods ordered cannot be returned without the express consent of Swiss Bar Shop. Individual agreements on delivery intervals, discounts, packaging, or custom-made products must always be confirmed in writing by Swiss Bar Shop. Prices may be quoted net, and Swiss Bar Shop reserves the right to demand advance payments, security deposits, or fixed payment terms. Partial deliveries are permitted, with the transport risk passing to the customer upon shipment. The warranty period for B2B customers is 12 months from delivery; normal wear and tear or improper handling are excluded from the warranty. Swiss Bar Shop's liability is limited to cases of intent and gross negligence, while slight negligence only applies in the event of a breach of essential contractual obligations. Liability for indirect damage, consequential damage, or loss of profit is excluded.
